Trial attorney

David H. McCain, Esq.

David McCain has spent 19 years building catastrophic injury cases for trial. His focus is the cases where the injuries are permanent, the stakes are highest, and a settlement that falls short means a lifetime of unmet need. Every case he accepts is prepared for trial from day one.

Built for the Cases That Require a Trial Attorney

Catastrophic injury cases are the center of this firm's work — and the center of mine. When someone has sustained a spinal cord injury, a traumatic brain injury, an amputation, or another life-altering harm, the legal process they enter has to account for everything that injury means for the rest of their life. That is not a claim to make at settlement. It is a framework to build from day one.

I joined this firm because Christy and I share a litigation philosophy: every case is prepared for trial from the moment it opens. A case that is not trial-ready is a case that settles for less than it should. After 19 years of trying serious personal injury cases in Georgia, that standard has not changed.

Every case I accept, I personally handle.

My published work covers two areas: the craft of trial storytelling and the specific complexities of trucking litigation.

  • "Write the Wrong: A Writing Workbook for Trial Lawyers" — a full-length trial method resource for attorneys developing their written advocacy skills.
  • "Damages House: A Storytelling Approach to Teaching Pain and Suffering" — published in Verdict Magazine.
  • "The Injured Trucker: Key Considerations in Multi-Truck Pile-Ups" — published in the AAJ Trucking Litigation Group Journal, Winter 2024.

These are practitioner resources written for the attorneys who try these cases — including the ones I teach at national boot camps.

Why Catastrophic Cases Demand This Approach

Catastrophic injury cases do not resolve cleanly or quickly — and they should not. The damages in a life-altering injury case extend across decades: future surgeries, long-term care, lost earning capacity, and the non-economic consequences of permanent disability. Settling before that picture is complete means accepting a number that was never designed to cover what the client actually needs.

Christy and I work together on the firm's most complex cases. She leads in trucking and commercial vehicle litigation. My concentration is catastrophic injury and serious personal injury — cases where the harm is permanent, the parties are multiple, and the preparation required to take the case to trial is significant. Together, we have the range to pursue every aspect of a high-value, multi-party catastrophic matter without farming any part of it out.

The firm accepts co-counsel and referral arrangements from other trial attorneys for catastrophic injury cases. If you have a serious injury case that needs Georgia trial counsel, reach out directly.

Every case I accept is built for trial from day one — not because every case goes to trial, but because that preparation is what gets the right result.

Giving back

In the Courtroom and the Community

Central Georgia CASA

I have served on the board of Central Georgia CASA — Court Appointed Special Advocates for Children — for ten years. CASA trains community volunteers to serve as advocates for abused and neglected children moving through the Georgia court system. For a decade, I have brought the same conviction to that board that I bring to this firm: that the people who need the most protection deserve someone willing to fight for them.

Mercer University School of Law

I also volunteer annually at Mercer University School of Law's Orientation Professionalism Class, teaching incoming law students about ethical and client-centered practice from their first days in law school. It is the kind of investment in the legal profession that reflects how this firm approaches its own practice.
